Terms of Service

Welcome to Assisty. These Terms of Service ("Terms") govern your use of the Assisty mobile application (the "App") and related services provided by Assisty ("Assisty", "we", "us", or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.

3. Subscription and Payments

3.1 Free Trial

We offer a 7-day free trial for new subscribers. During the trial, you have full access to all premium features. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

3.2 Subscription Plans

• Monthly Plan: $12.99 per month, billed monthly.
• Annual Plan: $59.99 per year, billed annually.

3.3 Billing

• Subscriptions are billed through Apple App Store or Google Play Store, depending on your device.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your device's account settings (App Store or Google Play).

3.4 Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Upload content that is offensive, harmful, or infringes on the rights of others.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Use automated systems (bots, scrapers) to access the App.
• Interfere with or disrupt the App's functionality or servers.
• Share your account credentials with others or allow multiple people to use a single account.

5. User Content

5.1 Your Content

You retain ownership of all photos, wardrobe items, and other content you upload to the App ("User Content"). By uploading User Content, you grant Assisty a limited, non-exclusive license to use, process, and store this content solely for the purpose of providing and improving our services to you.

5.2 Content Guidelines

You are solely responsible for your User Content. You must not upload content that:

• Contains illegal, abusive, or harmful material.
• Infringes on any third-party intellectual property rights.
• Contains malware, viruses, or other harmful code.

6. AI-Generated Content

The App uses artificial intelligence to generate outfit recommendations, styling advice, and other content. You acknowledge that:

• AI-generated recommendations are suggestions only and may not always be suitable for every context.
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
• You use AI-generated recommendations at your own discretion.

7. Intellectual Property

The App, including its design, features, code, AI models, and branding, is owned by Assisty and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the App will be uninterrupted, error-free, or secure.
• Any warranty regarding the accuracy of AI-generated outfit recommendations.

10. Limitation of Liability

To the maximum extent permitted by law, Assisty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of the App.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

• You may terminate your account at any time by deleting it through the App or contacting support@assisty.app.
• We may suspend or terminate your account if you violate these Terms, with or without notice.
• Upon termination, your right to use the App ceases immediately. Data deletion follows the timeline described in our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
